MOTORBOAT RENTAL AGREEMENT TERMS AND CONDITIONS

LESSEE: Person listed on the contract form
Due to the demanding rocky seabed, the motorboats are intended for use by experienced boaters.
1. Leased property:
The Lessor leases and the Lessee takes into temporary use a motorboat:
Tuna 422cc (aluminum, motor 20 hp Mercury, Garmin GPS, oars, year of manufacture 2020)
Kasse 320 (green plastic, motor 4 hp Mercury, oars, year of manufacture 2020)
Kasse 455-R (white plastic, motor 6 hp Mercury, oars, year of manufacture 2026)
2. Terms and rental period
Full day 8:00-20:00, half day 8:00-13:00 or 15:00-20:00
The rental period begins at the time agreed in the rental agreement and ends when the Boat is returned in accordance with the Rental Agreement. The time taken to hand over the boat, the accompanying user guide and return is included in the rental period.
3. Obligations of the Lessee
The Lessee is obliged to:
3.1. To inspect the boat for technical or mechanical failures upon receipt. If they occur, they must be recorded. The Lessee has the primary responsibility for inspecting the boat: if the inspection is neglected in whole or in part and a dispute later arises regarding when the damage occurred, the damage is presumed to have occurred during the rental period.
3.2. To use their own life-saving equipment (life jacket) or the equipment provided by the Lessor. Every person on board the boat must wear a life jacket or equivalent safety equipment, and the Lessee is responsible for ensuring that those on board comply with this obligation.
3.3. To use the boat only for personal trips (not to pass it on to third parties). The Lessee and the captain of each boat appointed by the Lessee are responsible for the use of the boat.
3.4. To be liable for any damage caused to him or her, third parties, and the boat because of an accident, collision, or filling with water. If the insurance covers the damage in full, the Lessee is exempt from liability for the damage caused to the boat, except for the insurance excess (currently EUR 500 per claim), which is always payable by the Lessee.
3.5. To use the boat in accordance with the technical instructions.
3.6. Not to use alcoholic beverages or drugs while steering the boat.
3.7. Always attach the motorboat securely and correctly to the floating dock using 4 points (Tuna) or 3 points (Kasse and rowing boats). You must take the key with you from Tuna and turn off the mains.
3.8. At the end of the day, refuel the motorboat from the spare canister provided and raise the engine to the upper position, i.e., the propeller is out of the water for checking. Clean the boat of any debris and bring the spare canister to the boathouse to be filled again.
3.9. Return and hand over the boat to the staff clean and on time at the end of the rental period, return the borrowed fishing equipment and life jackets clean to the storage building. If the boat is not returned in the same state of cleanliness as at the time of handover, Lessor reserves the right to charge a cleaning fee of [100 EUR].
3.10 At the end of the rental period, send a message to +358 440 872 875 regarding the boat number, arrival time, fuel level and condition, and leave the boat key in your accommodation building (place of stay).
3.11. If any damage caused to the boat or the Lessor is the result of the Lessee’s willful misconduct, gross negligence, operating the boat whilst under the influence of alcohol or other intoxicating substances, criminal intent, or any other material breach of the terms of the rental agreement, the Lessee shall be liable to compensate the Lessor for the full extent of the damage incurred.
3.12. Immediate obligation to report damage. The Lessee must immediately notify Lessor(tel. +358 440 872 875) of any faults, damage, collisions, theft or other incidents involving the boat, regardless of whether they have caused visible damage. In the event of damage, the Lessee must take all necessary measures to prevent further damage. A police report must always be made in the event of personal injury or theft (Maritime Rescue: 0294 1000 / Emergency number: 112). The Lessee must await instructions from Lessor before undertaking any repair work, unless immediate action is necessary to prevent further damage. If the Lessee fails to fulfil the obligations set out in this clause, they shall be fully liable for any loss incurred by Lessor as a result of such failure, including any portion of the insurance compensation that may consequently be forfeited.
4. Obligations of the Lessor
4.1. The lessor is obliged to provide the lessee with a boat that is technically and mechanically in good condition. If the boat has technical or mechanical defects, they must be recorded.
4.2. The Lessor provides 10 liters (Tuna 422cc) and/or 5 liters (Kasse) of petrol per boat per day.
4.3. The Lessor is obliged to provide the Lessee with operating and safety instructions in connection with the contract, which the renter will share with the captains;
4.4. Lessor is obliged to provide life-saving equipment (life jackets).
4.5. After the signing of this Agreement, the Lessor is obliged to make the boat available to the Lessee for the term specified in this Agreement.
4.6. Lessor shall inspect the boat after its return and notify the Lessee of any damage incurred during the rental period
4.7. Lesser reserves the right to refuse the rental if the Lessee’s skills or physical ability are insufficient for safe boating.
4.8. Lessor shall not be liable for any consequential or indirect losses incurred by the Lessee, such as travel costs, lost holiday days, loss of income, or other similar losses. Lesser’s potential liability to the Lessee shall in all circumstances be limited to an amount not exceeding the rent paid for the rental period in question.
These limitations do not apply to damages caused by Merikoivula Oy’s willful misconduct or gross negligence, nor do they limit the rights to which the consumer is entitled under mandatory legislation.
5. Other terms and conditions and liability of the parties
5.1. In the event of a breach of clauses 3.3, 3.5, 3.6, 3.7, of this Agreement, the owner has the right to immediately suspend or terminate this Agreement.
5.2. Lessor shall be entitled to terminate the agreement prior to the commencement of the rental period due to force majeure, such as exceptional weather conditions. In such a case, the Lessee shall be entitled to a full refund of the rent paid.
5.3. The Lessee has the right to terminate the agreement if the boat is substantially defective and Lessor is unable to provide a replacement boat within a reasonable time. In such cases, the rent paid shall be refunded in full.
5.4. In the circumstances described in clauses 3.4 above, the price of spare parts, repairs, and transportation shall be calculated in accordance with the estimates of the official resellers of floating equipment operating in Uusikaupunki and/or any other nearby location.
5.5. The LESSEE is fully liable for the damage or injuries caused to himself/herself or to third parties by the leased property during the term of the Agreement.
5.6. The person renting the boat must be of legal age. The person operating the boat must have sufficient knowledge and skills to handle the rented boat in the sailing area in question.
5.7. Persons under the influence of alcohol (if necessary, to be checked with a breathalyzer), drugs, or minors are not allowed to drive the boat.
5.8. The Lessee and captains are obliged to take care of the boat as a prudent person would take care of their own property and to exercise particular care and caution whilst underway. The Lessee undertakes, when using the boat, to observe the requirements imposed on the master of a vessel by the Maritime Act and to comply with all other applicable laws and regulations.
5.9. In cases not addressed in this agreement, the general terms and conditions for boat hire drawn up by the Finnish Marine Industries Federation shall apply.
5.5. This Agreement shall enter into force upon filling the form above.
